These Terms of use govern access to and use of the Agritake platform, including browsing the directory and submitting listings for farm self-service stands and other autonomous points of sale. By using the platform or submitting a listing, you confirm that you have read and accepted these terms.
1. Platform operator
The platform is operated by Agritake, a company registered in Switzerland. For any question about these Terms of use, you can contact Agritake at info@agritake.com.
In these terms, "Agritake" means the platform operator, while "user" means anyone who browses the website, submits a listing or uses any available feature.
2. Purpose of the platform
Agritake is an informational directory dedicated to farm self-service stands and other autonomous points of sale, including stands that may be open 24 hours a day. The platform promotes local producers and helps users discover and contact stand operators.
Agritake does not sell products, does not process economic transactions, does not guarantee that any sale will take place and does not act as a commercial intermediary between users, producers or self-service stand operators.
3. Listing submissions
Only the owner of the self-service stand, a family member or a person authorised to represent the indicated business may submit or update a listing.
Listings may be submitted only by adults or persons who are legally authorised to do so. Anyone publishing or submitting a listing confirms that they have the right to publish all information, photographs and other uploaded content.
4. Manual approval and checks
Agritake manually approves new submissions and may also manually approve updates to existing listings. Submission through the form does not create any right to automatic publication.
Agritake may request confirmations, corrections or data updates. Agritake reserves the right to reject or not publish a listing, including without any obligation to provide reasons.
5. Responsibility for content
The owner, operator or publisher is solely responsible for the content uploaded or communicated to Agritake.
Content includes, by way of example, descriptions, photographs, addresses, coordinates, contact details, products, opening times, websites, payment methods and any other information intended for publication.
Agritake checks new submissions and updates, but does not guarantee the completeness, accuracy, timeliness or error-free nature of the published information.
6. Photographs and usage rights
Photographs and other visual content may be uploaded by users. Whoever uploads them confirms that they own the relevant rights or are authorised to publish them and grant Agritake the right to use them.
Agritake may use uploaded images to publish the listing, promote the project, carry out communication and marketing activities, develop the platform and share content with authorised partners.
If recognisable people appear in images, the publisher must ensure that the necessary consents have been obtained. Unlawful, offensive, misleading content or content that infringes third-party rights must not be uploaded.
7. Public data, search engines, AI and partners
Self-service stand data is intended for publication and public consultation. Anyone submitting a listing accepts that this data may be visible online, shared by link and indexed by search engines.
Public data may be used by artificial intelligence systems, search tools, digital services and other automated systems to the extent permitted by applicable law.
Agritake may share, make available or license public data to authorised or selected partners, including tourism organisations, associations, local promotion bodies, partner platforms, technology services or parties interested in promoting local producers.
8. Removal, suspension and modification of listings
Agritake may modify, suspend or delete a listing, for example in case of outdated data, failure to respond to verification requests, content inconsistent with the purpose of the platform, false or misleading information, legal violations, offensive or inappropriate content, abuse of the service or risks to the platform.
The owner or responsible person may request removal of the listing and their data at any time by writing to info@agritake.com. Agritake may request additional information to verify the identity or authority of the requester.
9. Limitation of liability
Agritake does not guarantee that a self-service stand is actually open, that products are available, that prices are up to date, that information is correct or complete, that contact details are still valid or that the service is always error-free.
Agritake is not liable for direct or indirect damage caused by incorrect data, use of published information, third-party use of public data available on the platform, disputes between users and self-service stand operators or the quality, safety or compliance of products sold by individual producers.
Users should verify opening times, availability, products, prices, payment methods and sales conditions directly with the producer or point-of-sale operator.
10. Intellectual property and use of data
The Agritake brand belongs to Agritake. The platform, software, interface, content selection, database structure and technical and graphic elements are protected by applicable intellectual property laws.
Published data may be used only for personal consultation and for the purposes intended by the platform. Mass copying of data, automated scraping, resale of data, redistribution without written authorisation and any commercial use of data without a specific agreement with Agritake are prohibited.
Any fraudulent, unlawful, malicious use or use capable of compromising the operation, security or reputation of the platform is prohibited.
11. Service availability
Agritake may temporarily suspend, limit or interrupt the service for maintenance, updates, technical reasons, organisational reasons, security, force majeure or other operational needs.
Agritake assumes no liability for interruptions, delays, malfunctions, temporary loss of access or platform unavailability.
12. Evolution of the project
Agritake reserves the right to evolve the project and introduce in the future premium services, annual membership fees, advertising, commercial collaborations, technology partners, APIs, data reuse licences, services for artificial intelligence systems or additional business models.
The introduction of paid services or specific conditions may be governed by additional terms or updates to these Terms of use.
13. Proper use of the platform
It is prohibited to use Agritake for unlawful purposes, spam, unauthorised access attempts, malware distribution, automated data collection without authorisation, harmful activities or activities that may compromise the operation, security or integrity of the service.
Agritake may adopt technical, organisational or legal measures in case of abuse, improper use, breach of these terms or risk to the platform, users or partners.
14. Privacy
The processing of personal data is governed by the Privacy Policy, available as a separate document on the platform. Private contact details of responsible persons are not published on the map and are used for checks, operational communications and request management.
15. Changes to the Terms of use
Agritake reserves the right to modify these Terms of use at any time. The updated version will be published on the website and will be effective from the publication date, unless otherwise stated.
Continuing to use the platform or submitting new requests after an updated version has been published means accepting the updated terms.
16. Applicable law and jurisdiction
These Terms of use are governed by Swiss law, subject to any mandatory rules that may apply.
